Free Downloadable Month-to-Month Rental Agreement Templates

Renting a property can be confusing and stressful under normal circumstances, but when the landlord wants you out at the end of your lease term, it can become downright frustrating.

If you’re struggling to meet the spiraling rent or looking for a way to save money, renting out an apartment or house can become lucrative. Once you’ve settled on a rent, you may decide to allow a renter to stay on at a lower rate for a month or pay for the full month. Most landlords will be happy to offer a month-to-month tenancy, but there are some things you should know first to establish a solid policy.

These free downloadable rental agreement templates can help you form an agreement that works for both you and your tenant.

Examples of State Landlord-tenant Laws

Landlord-tenant Laws by State

Don…t sign a rental agreement that doesn’t adequately protect you.

Tenants with damage to the rental property may be responsible for the damage to the unit, but there’s a lot they can do to protect themselves before signing the agreement. By hiring an attorney familiar with the landlord-tenant laws in your state, you can ensure that the agreement meets your needs to minimize your risk.

Another thing to consider is the cost of the agreement. Having a lawyer look it over will generally cost you only a few hundred dollars. You can typically get a free month-to-month rental agreement template or make one that approximates what’s required by your state’s landlord-tenant laws on the internet.

From a tenant’s perspective, the main problem with the typical one-page or even two-page rental agreement is that it doesn’t provide the level of protection needed. For example, it doesn’t require the tenant to sign a confidentiality clause, which tends to be a good idea for tenants to use.

In some states, a tenant’s personal information such as social security number, date of birth, and driver’s license number may be required by the landlord for necessary purposes such as a rental payment.

When to Use a Rental Agreement Template

When you rent an apartment, house, or mobile home, you’ll need to sign a rental agreement with the landlord. One of the most important points to emphasize in a rental agreement template is that you are agreeing to rent the property for one month or more, depending on the rental period. Without this, any breach of the agreement is not grounds for termination.

You may already have a rental agreement with a landlord, but you may not know how long it lasts. You may have just signed so that you could move out next week (yes, that actually happens). You may have signed a lease where the length of your rental is unclear. Regardless, in order to be sure that the terms of your agreement are understood, you’ll need a rental agreement template.

Who a Month-to-Month Rental Agreement Is Right For

You should definitely have an agreement between you and your tenant to ensure that they are treating your rental property well. It is important for you to protect yourself as well as for them to hold all of their rental expenses, protect you from liability, decrease the stress of maintaining the rental property, and ensure that the tenant is allowed access to the property.

Reasons why a Month-to-Month Rental Agreement Is a Good Idea

A month-to-month rental agreement is simply an agreement that cannot be renewed for a specified period of time (normally one or two years). This agreement only has one option on whether they want to renew it.

Because of the brevity of this agreement, there are fewer uncertainties and difficulties when changing the tenant or second guessing what they have done.

It is clear to the tenant exactly how much rent they are paying. Being able to visualize and detailed to plan their living expenses helps them know exactly what to budget. This is especially valuable to people who are independent as they may have an irregular income stream.

If you are going to have a month-to-month rental agreement with your tenant, you will want to provide them with everything they need to know. This includes a list of the landlord’s expectations. This will make it easier for them to know what they need to do and, at the same time, protect you from any liability.

Who a Month-to-Month Rental Agreement Is Not Right For

Although a month-to-month rental agreement is great when you’re just getting started, it’s generally no good if one of the parties is a business and wants a longer term rental agreement or wants to tie the two parties together for a specified time period.

A month-to-month rental agreement is a good choice if one of the parties cannot afford to make a long term investment, or if you’re simply trying to rent a home and not buy it. For this reason, it’s also usually pretty easy to get the kind of lease you want, such as a three- or a six-month lease.

There are two advantages to deciding on a month-to-month rental agreement instead of a standard lease agreement, which is a long-term agreement. First, you and your tenant will have more time to get the relationship off the ground. Second, it will be easier to end the relationship on good terms if for some reason you’re not getting along with your tenant.

What to Include in a Month-to-Month Rental Agreement

This template is an example of a monthly rental agreement between two parties – a landlord and tenant. This sample rental agreement is for a one bedroom apartment. It includes a section for the landlord and tenant to address their discussions over and sign.

As a landlord, you may want to amend the agreement with your tenants if you find that your standard one bedroom costs way too much for the income they provide. If you have tenants who are disabled, mentally disabled, elderly, and have the potential to lose their job, be willing to negotiate with them. However, you might want to leave the rent unchanged in those cases.

Here’s what the tenants need to give you in a landlord-tenant agreement:

{1}. A basic overview of the apartment, including the names of any roommates who may live with them.
{2}. Name and contact information of the tenants, including their phone numbers, home and office addresses, and work phone numbers.
{3}. Date and description of the move-in and move-out dates for the apartment.
{4}. Address and description of the apartment, including the amount of square footage.
{5}. A list of anything that should be included in the apartment, such as a dishwasher, washer and dryer, or furniture that is supposed to be in the apartment.

The Term of the Rental Agreement

The party signing the lease will be responsible for paying the monthly rent, taxes, and utilities. These are the main costs associated with this kind of business blog. But there are other things such as the broker’s fee which can occur during the term of the rental agreement.

The main difference between a month-to-month and a yearly lease is the term of the agreement. However, the general terms are the same. Broker’s fees will definitely increase the monthly rent and they will be paid by the tenant.

In order to create a free template of the lease, it is best to have the interest something like monthly, three months, six months, and a yearly rental agreement. You will then be able to print it out on a blank piece of paper and get it signed that way.

Security Deposit for a Month-to-Month Rental Agreement

Security deposits are the most common form of payment as security for the tenant of a property. The landlord is responsible for collecting any security deposit held against the tenancy from the tenant. When a tenant enters into a month-to-month or week-to-week tenancy agreement, the landlord will be responsible for holding a security deposit against the tenant. The landlord is also responsible for holding the security funds in accordance with the terms of the tenancy agreement.

Before any deposit is held, the tenant will be asked to answer a questionnaire and provide personal or financial info to the landlord. The tenant has the right to provide their own written information required of them. The tenant must also be aware of what is required by the landlord before any deposit can be held.

A defense to a demand for security deposit can be provided by providing sufficient notice to the landlord of the termination of the tenancy. Moving out early from a rental property is a common reason to deny a security deposit. The landlord cannot deny a deposit because the tenant has relocated or because the tenant is moving in with the landlord.

Here is an example of a monthly rental agreement template if you are trying to tie into a property. Then your tenants can use this template before they actually move in to begin this process.

It says that the tenant has a firm agreement for renting the property. You also want to do this so that nothing could be misunderstood or too much blame can be put on you.

Amount of Monthly Rent in a Monthly Lease Agreement

If you are trying to find an easy way to get better negotiating power when leasing a property, then a monthly rental agreement template could be the answer for you.

These templates come complete with much of the legalese you need to address in a legally binding contract and may also have very helpful provisions about deposits, term leasing and payment terms.

A standard monthly rental agreement will always be used when a property is being leased on a month-to-month basis, but there may be times when the tenants require more or less security from the landlord.

This is where a monthly rental agreement template could help save time and suffering with the negotiating of a settlement agreement.

You can also use it to help you when you are negotiating a settlement agreement with an existing tenant. It can also be helpful afterwards as you may want to review old agreements.

If you need to address any particular clauses regarding rent, you can do that by stating this in your contract.

All you need to do really is to review the proposed agreement and then make the necessary changes to what you want to use.

Month-to-Month Rental Agreement Late Fees & Returned Payment Fees

The main problem with using a rental agreement is that it creates an adversarial relationship between landlord and tenant. And be prepared to pay the price when it comes to late fees.

Most landlords use a month-to-month rental agreement, which is similar to renting an apartment. The terms of the agreement are generally very similar to those for a lease—all set out in the document—but the landlord and tenant don’t both have to sign.

Given that most tenants prefer to move into a new rental quickly and that they don’t have to move at the end of the agreement, many landlords prefer to keep things informal. Here are the main features of your standard rental agreement.

If you don’t pay the bill on the due date, the rent is due immediately. Given the importance of prompt payment, landlords usually charge much higher late fees and penalties for late rent payments than they do for late checks.

The landlord can also charge you for the cost of lost rent, which is what your landlord pays for you to find somewhere else to live.

If you stop paying your rent, the landlord still has to maintain the rental property and abide by all the terms of your agreement. So, rather than try to evict you, your landlord may simply let you to move out at any time since you’re already breaking the terms of your agreement.

Number of Occupants Allowed in a Month-to-Month Rental Agreement

The number of occupants that are allowed in a month-to-month rental agreement will depend on the state where you are renting. One important thing to note is that all renters are not entitled to the same terms when it comes to governing the rental agreement.

While all states allow for the landlord and the renter to agree upon allowing more than one person to live in the rental unit, the caveat is that everyone sharing the rental unit must be related to one another. So if your rental agreement states one person can live in the rental unit, it does not mean that it should be clear if that same rental agreement also includes cases where the same number of people are allowed to share the rental unit if they aren’t related to one another.

Having said that, most states only allow the landlord and the renter to agree upon one family-sized unit or group of unit. However, that is not the only factor involved in allowing more people to share the rental unit. Each state also allows the landlord and the renter to agree upon allowing more than one family-sized unit from the same person to share the rental unit at the same time. This is more often brought to the forefront when the state requires tenancies to be registered.

Insurance Required for a Month-to-Month Rental Agreement

The free Month-to-Month Rental Agreement template is an easy to use rental contract that is perfect for landlords or tenants. The free contract can be used by landlords to protect themselves against claims and by tenants to protect themselves in a tenant-landlord dispute.

The basic information you should include can be found on the sample contract to the right, e.g. the names and addresses of the parties involved, the address of the property, the length of the rental agreement and the name of the property manager if applicable.

The rental agreement should clearly state the terms of the rental agreement like the daily rent amount or monthly rent amount. If the tenant wants to opt out of the rental agreement the landlord should be given reasonable notice. The tenant should also be responsible for the check-in and check-out of the house.

If the agreement specifies a certain date for the tenant to move out, the tenant will be considered a month-to-month tenant if they are still living in the house on the last day. However, it is not a month-to-month tenant if the tenant has not lived in the house for more than a full year.

In that case, the landlord may consider a lease type tenancy agreement, which may not require giving the tenant several months’ notice to move out.

Maintenance in a Month-by-Month Rental

Many times, landlords and tenants negotiate a rental agreement on a month-to-month basis. Since the termination date of the rental does not exist, there is often no idea of when the unit will be available and when the landlord can access the unit.

A few examples of lease terms are as follows:

Tenant agrees to pay for all services, utilities and repairs but the tenant is not responsible for paying property taxes.

Tenant and landlord agree to pay for all utilities and repairs and tenant is responsible for property taxes.

Tenant and landlord pay their share of the utilities and repairs and the tenant is responsible for property taxes.

Landlord pays for utilities and repairs and is responsible to pay property taxes.

Or

The landlord pays for utilities and repairs and is responsible to pay the property taxes.

In any of these examples, the landlord maintains the unit. In addition, the landlord is responsible in maintaining the common areas. Some of the areas include the following:

  • Freezer
  • Washer and Dryer
  • Dishwasher and Range
  • Garbage Disposal
  • Trash Composter
  • Shared Car Port
  • Common Patio/Garden

In other words, what you pay to your landlord for rent is what you get. There are no extra charges. The unit comes with the following services and utilities:

  • Heat
  • Water

Month-to-Month Rental Agreement Landlord & Tenant Responsibilities

A month-to-month lease agreement is an informal type of lease agreement. These arrangements usually occur without a binding agreement, but it can be used by both parties to create a valid rental agreement. Essentially, both parties date, sign and return the contract.

In some situations, a month-to-month lease agreement can be a convenient alternative to a standard three to five year lease agreement. For tenants, this agreement allows them more flexibility than a standard lease agreement. Landlords can also take advantage of this type of agreement, but must complete a detailed rental application and collect certain documents no matter what type of agreement they have with their tenants.

From a property owner’s perspective, a month-to-month lease agreement can make it easier to manage tenants or resell the property. These types of arrangements generally offer less protection to the landlord or property owner than a standard lease agreement, however. Landlords also must prepare and maintain all of the required paperwork regardless of the type of rental agreement they have in place.

Subletting a Month-to-Month Rental Agreement

If you’re a renter, you’ve likely signed a month-to-month rental agreement. Since they, in general, do not last for a long time, you may need to sublet your place. If you do not have a free month-to-month rental agreement, you are going to have to write up your own or find one online. This can be done by consulting with your landlord or just printing up a blank agreement from the Internet.

Subletting is a way of longer leasing your apartment. This may seem like a positive thing. However, it also means you are going to be coming and going from your apartment frequently. You will also be responsible for any damages incurred during whatever period you are at the apartment. If your landlord likes the tenant he or she is currently renting to, it may mean problems for you as well. You don’t want to find yourself in the position of having to move out unexpectedly or having to pay the rental fees for the place that you moved out of.

Quiet Enjoyment of a Monthly Rental

When you maintain a quiet enjoyment of a rental home, you are letting the world perceive that you are enjoying the property, paying your rent and keeping the property in a clean and presentable condition.

When you have this quiet enjoyment, your rental house will be able to attract other future renters.

Survey of the Rental

Before the agreement is executed, both the landlord and the tenant must conduct a survey of the rental home and identify any defects. The survey must include:

Such as cracks, holes, stains, water damage, or mold. If the rental property shows any major

Defects, this should be included in the rental agreement. During this inspection, both you and the

Landlord can identify any defects, which will be included in the inspection report.

When you have a contract, it is unlawful for one of the parties to add anything additional to the contract without the other party's (tenant's) knowledge and approval in writing.

Include the Conditions of Use

Create a written statement of the following:

  • the tenant's name and address
  • the date that the rental agreement begins
  • the amount of the monthly rent, which may be determined by the date that you return the security deposit
  • how long you plan to reside in the rental
  • identification of the lease or rental agreement and the number for the FBI

Termination of a Month-to-Month Rental Agreement

Month-to-month rental agreements are the most common type of rental agreement used by landlords and tenants. They typically assume that the rental arrangement will continue until the lease or rental agreement expires or it is terminated by either party.

Most month-to-month rental agreements in Michigan are month-to-month agreements although an option where the landlord can option to terminate the agreement after expiration has been available for some time. The requirements for providing an option to terminate after expiration have been determined to be satisfied by the landlord – at least 90 days in advance – providing written notice to the tenant of the landlord’s intent to terminate the tenancy after the expiration of the rental agreement.

For more information about the new rules and requirements for termination by the landlord of a month-to-month rental agreement after expiration, click here or here.

The landlord must also keep their end of the lease and make timely rent payments. For more information about what the tenant’s responsibilities are for the landlord and the landlord’s responsibilities for the tenant, click here.

Month-to-Month Rental Agreement State Laws, Rules & Addendums

What happens to my contract if I move?

Once you sign a Month-to-Month or Fixed-Term Rental Agreement with a landlord, you are tied to the rental agreement. In some states, landlords have the exclusive right to transfer the premises at any time during the rental period. However, even in all states, you may be able to break the rental agreement for certain reasons as the landlord may not be able to prove you breached the agreement.

If the landlord agrees to break the rental agreement, you can terminate the agreement (generally for agreed reasons) with the landlord’s consent. There is nothing preventing the landlord from ending the agreement at any time, but if the landlord agrees to break it, that agreement will not be binding on either the landlord or the tenant.

Monthly Rental Agreement Signatures

This kind of agreement is found mainly in the music industry, where someone gives you a free trial use of their gear.

A monthly rental agreement is no different in principle. Essentially, you agree to rent a piece of equipment for a month. During the month, you will pay rent (or instalment payment) to your customer (the company or individual who is giving you the equipment). This monthly rental contract is a standard contract that must be signed by both the renter and the owner.

This agreement usually uses the word "month" or "months" to describe the duration of the rental period.

A monthly rental agreement has a series of required clauses, usually a start date and an end date. The end date must be specified for the renter's benefit so the company cannot cut off the owner's equipment at month end. The end date is usually the last day of a specific month, but it can also be an arbitrary date in the future, such as the last day of the year or the last day of the month.

Month-to-Month Rental Agreement Template Frequently Asked Questions (FAQs)

If you’re on the hunt for a great free contract template, you’ve come to the right place. Why? Because in the following section, we’ll share a spreadsheet version of a common rental agreement agreement that you can use as an example.

This template can be used whether you’re a landlord or tenant. If you’re a landlord, you can use the template to outline terms and conditions when you’re renting your residence. If you’re a tenant, you can use the template to help you protect yourself against coverage risks.

But before we get into the details of the template, let’s see what your questions might be when it comes to renting out property. So let’s get right into it.

Do You Have to Give 30 Days’ Notice on a Month-to-Month Lease?

A month-to-month lease agreement doesn’t guarantee a set period of time… Instead, a month-to-month lease agreement is a fixed-term lease that an agreement provides for the landlord to rent out his property for a specific amount of time (usually one month). The tenant usually agrees to pay a deposit up front as a sign that he or she wants to rent the property and also agrees to sign a month-to-month lease agreement.

To renew the month-to-month lease agreement before the agreed date, the tenant must give the landlord a 30-day… notice. Although a 30-day period is the minimum for the landlord to decide whether to give the tenant another month-to-month lease, most landlords will ask the tenant to renew the lease at least once and usually will renew the month-to-month lease for two months, three months, or a full year.

If you like a month-to-month lease agreement and you’re looking for a place to stay, it is key to know the proper notice you must provide to your landlord before monthly rent is due.

Can a Landlord Terminate a Month-to-Month Lease Without Cause?

Landlords must have valid grounds to terminate a month-to-month tenancy. If there are no valid grounds to evict the tenant, the tenancy may be terminated only upon written notice to the tenant.

A landlord is not allowed to arbitrarily evict a tenant, but can terminate a month-to-month tenancy only for a valid reason, such as:

  • nonpayment of rent
  • breach of agreement
  • damages to the rental property

If your landlord wants to terminate the month-to-month tenancy, make sure you know your rights. If the landlord tries to use a valid ground to end your tenancy without a legitimate reason, you can fight the eviction in court without the fear of being evicted.

How to File an Eviction on a Month-to-Month Tenant?

If you’re renewing the rental agreement for the month-to-month tenant, use this template (Download for Free!) to have a month-to-month rental agreement and to file the eviction notice.

People are always looking for excess income to boost their finances and thus, a great means to raise the income is by renting out a room in their house. However, if a tenant is trying to avoid you from dispossessing them, or they’re non-payment, the best way to get your rights is to file the eviction notice and give the tenant a fixed period.
